2. Scope and Applicability
These General Terms and Conditions apply to all offers, orders, sales, and deliveries of hardware products (such as PCBs, flight controllers, mesh devices) via https://takeyourgear.com. By placing an order, the customer agrees to these Terms and Conditions. Any contrary terms proposed by the customer are not accepted unless expressly agreed in writing.
3. Products and Orders
• All products are described and illustrated as accurately as possible on the website.
• EUnify BV reserves the right to correct errors or update product information at any time.
• An order is binding once payment is confirmed.
EUnify BV reserves the right to refuse or cancel orders in case of:
◦ Payment issues
◦ Fraud or suspicion of fraud
◦ Product unavailability
4. Prices and Payments
• All prices are in EUR and include VAT unless explicitly stated otherwise.
• Delivery costs are shown during checkout.
• Payment is due immediately upon ordering and must be made via the available payment methods.
• Orders are only processed after full payment.
5. Delivery
• Deliveries are made to the address provided by the customer.
• Delivery times are estimates and not binding.
• Risk of loss or damage passes to the customer upon delivery.
• If a product is unavailable after purchase, the customer will be notified and offered a refund or alternative.
6. Right of Withdrawal (B2C only)
• Consumers (non-professionals) have the right to withdraw from the purchase within 14 days after receiving the goods, without providing a reason.
• To exercise this right, the consumer must notify us in writing via email.
• The product must be returned in original, unused condition at the customer’s expense within 14 days of notification.
• Refunds will be processed within 14 days after receiving the returned goods.
Exceptions: The right of withdrawal does not apply to:
◦ Custom-made or clearly personalized products
◦ Opened or used components that cannot be resold for technical reasons
7. Warranty and Liability
• Products are covered by the legal warranty of conformity (2 years for consumers).
• The customer must notify any defect within 2 months of discovering it.
• Warranty does not cover damage caused by misuse, improper installation, modifications, or external causes.
• EUnify BV’s liability is limited to the replacement or refund of the product. Indirect damages (e.g., data loss, loss of profit) are excluded.
8. Returns and Repairs
• If a product is defective within the warranty period, the customer should contact us at support@takeyourgear.com with proof of purchase and description of the problem.
• Return instructions will be provided. Returned goods must be packaged securely.
9. Intellectual Property
All content on the website, including logos, texts, images, and designs, is the property of EUnify BV or its licensors and may not be copied or used without permission.
10. Force Majeure
EUnify BV is not liable for delays or failures caused by events beyond its reasonable control, including but not limited to natural disasters, war, internet outages, supplier failure, or strikes.
11. Governing Law and Jurisdiction
These Terms are governed by Belgian law. In case of disputes, courts of the judicial district of Ghent have exclusive jurisdiction, unless otherwise required by mandatory consumer law.
